1. NEW MEMBERSHIP CRITERIA

1.1 To apply for a new Priority Banking membership with the Bank, a customer must have a total combined liquid assets of RM 200,000 or such other amount as may be stipulated by the Bank from time to time (the "Minimum Balance"). For the purpose herein, the term "liquid assets" shall mean all sums standing to the credit of any Fixed Deposit Account, Savings Account, Current Account and / or Foreign Currency Account with the Bank and the principal amount of investment in any Unit Trust Funds and / or Structured Products with the Bank at any one time.

1.1.1 The Bank reserves the right to add to, delete from or otherwise vary the definition of liquid assets at any time or from time to time.

1.1.2 All customers who apply for the Priority Banking membership must open a Hong Leong OneAccount at the time of application. The minimum opening balance for the Hong Leong OneAccount is RM 20,000.

1.1.3 The remaining amount to make up the Minimum Balance may be made up of any other liquid assets as decided by the customer.

1.2 At the time of application, the customer(s) shall open an account on the Bank's Prescribed Forms and shall provide the name(s) and specimen signature(s) of the person(s) authorised to give and / or sign instructions on behalf of the customer(s) (the "Authorised Signatories").

2. MEMBERSHIP DEFINITION & MAINTAINANCE

2.1 Where there are more than one (1) person applying for the Priority Banking membership, they must open a joint account. As between the joint account holders, the joint account holder whose name appears first in the records of the Bank will be the Principal account holder and the other joint account holder will be the Secondary account holder.

2.2 Where the Bank is instructed and authorised to act on the instructions of any one of the joint account holder, the Account(s) may be operated and / or closed by any one of such joint account holder. Where the Bank is authorised to act on the instructions of both or all of the joint account holders, the Account(s) may only be operated and / or closed by both or as the case may be, all the joint account holders. The joint account holders shall be bound jointly and severally by all transactions effected thereby and by these Terms and Conditions.

2.3 The Member shall immediately inform the Bank in writing of any changes in address, contact numbers, Authorised Signatories, or other particulars that may be made from time to time. Until the Bank is in actual receipt of the Customer(s)' notification of such changes, the Bank is entitled to rely on the last list of Authorised Signatories and other particulars, on record with the Bank.

2.4 The Principal account holder must maintain the Minimum Balance in liquid assets at the point of account opening, with or without the Secondary account holder. For the first Secondary account holder, the Principal account holder may aggregate all his liquid assets tagged under his account as well as the liquid assets held under the joint account held by the Principal account holder and the Secondary account holder.

However, for subsequent account(s) opened with other joint account holder(s), an additional RM200,000 in liquid assets or such other amount to meet the Minimum Balance must be maintained in order to qualify for the joint account holder Priority Banking membership.

2.5 To remain as a member of Hong Leong Priority Banking Services, the Member must maintain at all times a monthly average Minimum Balance in liquid assets in the Member's account(s) with the Bank or such other amount as the Bank may decide from time to time.

2.6 The preferential rates offered on selected products / services are applicable only to the Principal account holder. The Secondary / supplementary accountholder however are still able to enjoy the services offered to Priority Banking Principal account holder. Principal account holder must maintain the Minimum Balance to enjoy the benefits.

2.7 Member shall be responsible for ensuring that there are sufficient funds in the Member's account(s) to carry out the transactions required by the Member.

3. PRIORITY BANKING PRIVILEGES

3.1 Priority Banking Debit Card

3.1.1 A Priority Banking Card ("the PB Card") will be issued in the Member's name, which allows the Member to enjoy the recognition, benefits and services offered by the Bank to its Priority Banking customers from time to time with the presentation of the PB Card at any Priority Banking Centre/ branches. The PB Card shall at all times remain the property of the Bank and shall be surrendered upon demand or upon the termination of the service herein.

3.1.2 The PB Card is issued solely for the use of the Member who shall not transfer, pledge or otherwise use it for any other purpose than that which is permitted under the terms and conditions herein contained.

3.1.3 The PB Card is issued only to account holders of savings / current account only. This condition is also applicable to joint account holder(s), if any. The cost of the new card issuance will be borne by card holder(s).

3.1.4 The PB Card will enable the Member to access the Bank's ATM facilities and the prevailing terms and conditions governing the use of the Bank's ATM facilities shall apply to the Member.

3.1.5 The Member shall take all precautions to prevent loss or theft of the PB Card and observe any and all security features connected with the PB Card. Where the PB Card is lost, stolen or misplaced, the Member shall immediately inform the Bank of the same in writing and the member shall remain liable for all transactions effected with the PB Card before such written notices is received by the Bank.

3.1.6 The Bank may re-issue a new PB Card in replacement of the lost, stolen or misplaced card and reserves the right to impose any changes in connection with the same. The new card or replacement card shall be subject to the terms and conditions prevailing at that time which will be available on request from the Priority Banking Centres.

3.1.7 The Priority Banking Centres will be opened during normal banking hours on Business Days.

3.2 The Member's Account(s)

The terms and conditions governing the respective bank account(s) of the Member, whether express or implied, insofar as they are not inconsistent with the terms and conditions herein, shall apply to the opening, operation and closing of the bank account(s) and the transactions effected.

3.3 Interbranch Personal Cheque Encashment

The Member can access the Bank's Interbranch Personal Cheque Encashment with the PB Card subject to any limit which may be imposed by the Bank from time to time and at any time.

3.4 Credit Card

The Bank will offer a complimentary Hong Leong Bank Platinum credit card to the Member subject to the conditions set by Bank Negara Malaysia on minimum income requirement. In the case of joint Members, the Principal Account holder will be issued the principal card and the other(s) will be issued with supplementary card(s). Only one free supplementary card will be offered. Additional credit cards requested by a Member will be subject to the Bank's prevailing fees and charges. The prevailing terms and conditions governing the use of credit cards issued by the Bank shall apply to the Member.

3.5 Cheque Pick-up Service

3.5.1 Priority Banking Customers may request for cheque pick-up service by calling up the Priority Banking Toll-Free number.

3.5.2 The Bank reserves the right to provide the assigned courier company with the Member's contact number to facilitate the pick-up service.

3.5.3 The pick-up service is only available to Priority Banking Customers within Kuala Lumpur and Petaling Jaya.

3.5.4 When using the said pick-up service, the Member is required to:

(a) Use the Bank's prescribed cheque deposit slip;

(b) Fill in the details of the cheque(s) in the cheque deposit slip; and

(c) Insert the cheque(s) and the completed deposit slip into a courier flyer and seal.

3.5.5 The Bank will not be held liable for the following:-

(a) loss of any cheque which was not recorded in the deposit slip;

(b) cheque(s) recorded in the deposit slip but not contained in the envelope; A copy of the cheque deposit slip is to be retained by the customer for their reference before they insert the cheques into the envelope.

(c) dishonoured cheques;

(d) any loss or damage whatsoever suffered by the Member howsoever arising from or caused by any delay in cheque pick-up or delivery for the purpose of all types of investments, payment and any other types of transactions;

(e) loss of any cheque howsoever caused by the relevant courier company.

3.5.6 The cheque pick-up service shall be subject to the following charges which shall be borne by the Member:-

(a) Courier charges

(b) Additional pick-up attempts arising from the Member's failure to adhere to the pick-up arrangements

By using the cheque pick-up service, the Member irrevocably authorizes the Bank to debit any of the Member's account for the abovesaid charges.

3.5.7 In the event any cheque(s) is reported lost or damaged by the Bank, the Bank's liability shall be limited to the actual value of the cheque(s) subject to a maximum of RM100.

3.5.8 All cheques picked up within the stipulated time frame will be submitted for clearing on the next Business Day.

3.5.9 The process of clearing the cheque will be subject to the Bank's prevailing conditions, rules and regulations governing deposit accounts including any regulations or directives by any Malaysian regulatory authority.

3.6 Other Priority Banking Services

3.6.1 The provision of Priority Banking Services shall be governed by the respective terms and conditions relating to the respective products and services. The terms and conditions for such products and services are available for inspection at the Member's request and the Member shall be deemed to have read and understood the said terms and conditions and shall be bound by the same upon the use of such product or service. Where there are any inconsistencies between the Terms and Conditions herein and the terms and conditions for such products or services, the terms and conditions for that product or service shall prevail.

3.6.2 The Bank may from time to time send to the Member, based on the Bank's records of the Member's personal data, information / offer of any new product or service offered by the Bank.

3.6.3 A consolidated statement of account containing information relating to account(s) held in the Member's name at the Bank or third party product / services marketed by the Bank may be issued and sent to any of the addresses furnished by the Member to the Bank.

3.6.4 The Priority Banking membership of a Member is subject to regular review. The Bank may terminate the membership at any time without prior notice if the minimum requirements are not complied with, or for any other reasons whatsoever without any obligation on the part of the Bank to furnish reasons for the same. The customer in retaining any one or more of the services shall be governed by the Bank's Terms and Conditions relating to such services and the provisions of any forms / mandate(s) pertaining thereto.

3.6.5 The provision of fax, internet and meeting room facilities at the Bank's Priority Banking Centres are for the convenience of the Member only. The Bank will not be, directly or indirectly responsible or liable for:-

  • any delays, errors or malfunction in the transmission or receipt of messages sent via the said fax or internet facilities
  • Any loss, damage or injury caused to the Member or any other person during the Member's use of the fax, internet or meeting room facilities
  • Any acts or commissions of the Member or any other person in using the said facilities, as they do not represent the Bank's endorsement of such acts or omissions of the Member

and the Member shall indemnify and hold the Bank harmless any and all consequences, actions, proceedings, liabilities, claims, losses, damages, charges, costs and expenses whatsoever which may arise or be incurred or suffered by us arising from or in connection with your use of the said facilities or any of the aforesaid matters.

3.6.6 The products / services / privileges provided under the Bank's Priority Banking may be varied, suspended or withdrawn or terminated at any time or from time to time without prior notice to the Member. The Bank shall not be liable in any way for any loss, damage or liability arising as a result of or howsoever in connection with any such variation, suspension or withdrawal of all or any part of the products / services / privileges provided.

3.6.7 These Terms and Conditions are to be read together with the General Terms and Conditions for all Accounts with the Bank. A copy of the General Terms and Conditions is available upon request.

3.6.8 For services where a Priority Banking customer has requested a third party to execute, the services requested will be personal to holder of Priority ATM card only.

3.7 Oral / written instructions

3.7.1 All instructions with respect to the Member's account(s) given by the Member are irrevocable and shall be in writing. The Member shall ensure that the instructions given are clear and accurate. Where applicable, prescribed forms by the Bank shall be used for giving instructions.

3.7.2 The Member may give instructions via electronic means to the Bank and hereby irrevocably authorizes the Bank, which in good faith believes to have emanated from the customer, to treat such instructions as fully authorised and binding upon the Customer notwithstanding that it is subsequent shown that the Customer did not authorise the same.

3.7.3 The Customer agrees and confirms that the Bank is entitled to treat the Electronic Instructions without any inquiry on the part of the Bank as to identity / authority of the person giving or purporting to give such instructions and the Bank will in no way be responsible for any misuse or unauthorised use of the electronic means to communicate the instructions and that that the Bank shall be discharged from liability.

3.7.4 The Member understands and fully acknowledges the inherent risks associated with the use of the electronic means to communicate instructions.

3.7.5 The Customer further acknowledges and agrees that the Bank is not responsible for erros, omissions, unauthorised use, duplication of any such Electronic Instructions by / on behalf of the Customer and that any misunderstanding, loss or delay resulting from such instructions are entirely the risk of the Customer.

3.7.6 The Customer hereby undertakes to hold the Bank free from liability and keeps the Bank indemnified in full against all or any loss, claims, demands, costs, damages, expenses (including legal fees on Solicitors and own client basis) and all other liabilities, whatsoever which may be incurred by the Bank or to which the Bank may be put in consequence of the Bank accepting and acting on the Electronic Instructions.

3.7.7 The Member may give instructions orally over the telephone to the Bank and hereby irrevocably authorizes the Bank to act on any such oral instructions. Any such oral instructions must be immediately confirmed in writing sent by fax or by hand to the Bank provided that any failure to do so shall not affect anything done by the Bank in reliance on such oral instruction. The Bank may at any time refrain from acting promptly upon any such oral instructions given in order to verify the authenticity thereof without incurring any responsibility for loss, liability or expense arising from acting on or refraining from or delay in acting on such instructions notwithstanding that it is subsequently shown that the same was not given by the Member.

3.7.8 All instructions given by the Member shall be deemed to be new instructions when it is unspecified that the instructions are a confirmation or a change of any previous instructions given.

3.7.9 The Member agrees that the Bank shall not be obliged to inquire as to the purpose of any transfer of funds or assets so authorized by any such instruction or the identity of any transferee.

3.7.10 Recording: The Bank shall be entitled to record all telephone instructions and conversations. All such recordings shall remain the property of the Bank and shall be conclusive evidence of the instructions given and are binding on the Member. The Member hereby agrees and consents to such recordings.

3.8 Priority banking service charge / fee

3.8.1 The Bank may impose a monthly / quarterly / half-yearly service charge / fee or any sum as may be determined by the Bank as its absolute discretion at any time or from time to time if the monthly average combined liquid assets in the Member's accounts (All accounts tagged under Principal account holder) fall below the Minimum Balance. The Bank reserves the right to impose any other fees, charges or levies on any of the services offered without prior notice to the Member. The fees, charges and levies deducted are not refundable.

3.8.2 The Member hereby authorizes the Bank to debit any of the Member's account(s) for such fees, charges or levies from time to time and if no account has been designated for this purpose or if the account designated has insufficient funds, the Bank is hereby authorized by the Member to debit any other account of the Member for this purpose without notice or concurrence of the Member.

3.9 Cancellation of Priority Banking membership

3.9.1 The Priority Banking membership of a Member may be terminated or cancelled by the Bank in any of the following events:-

(a) By giving written notice and completing and submitting a form (Service Request Form) to the Bank of the Member's intention to terminate the same; or

(b) If the Member defaults in any loans or facilities granted to the Member by the Bank or by any other financial institutions; or

(c) Upon death or insanity of the Member or if the Member serves any custodial sentence or commits an act of bankruptcy; or

(d) If there is any change in law or regulation which makes it impossible or unlawful for the Bank to continue to make available the Priority Banking services

3.9.2 Notwithstanding the above, the Bank reserves the right to suspend or terminate any or all of the services available under the Bank's Priority Banking Services at any time without notice to the Member and without assigning any reason therefore or incurring any liability to the Member.

3.9.3 Immediately upon termination of the Priority Banking membership whether by the Member or the Bank, the PB Card shall be returned to the Bank.

3.9.4 Upon the termination of the Priority Banking Membership whether by the Member or by the Bank, any debit balance in the Member's account(s) shall become immediately due and payable.

4. INDEMNITY

The Member shall fully indemnify the Bank against all claims, demands, actions, proceedings, loss, cost and expenses (Including legal fees on a full indemnity basis) and other liabilities incurred or suffered by the Bank acting on the Member's instructions or from the Bank refusing as it deems fit to act on any part of such instructions or in connection with the use of the services or products offered under the Bank's Priority Banking Services or in enforcing these Terms and Conditions and the recovery of the amounts due to the Bank or incurred by the Bank in any legal proceedings of whatever nature. Where the Priority Banking membership is extended to two or more customers jointly, the joint customers shall be jointly and severally liable for any and all liabilities incurred herein or in connection herewith.

5. GENERAL

5.1 Change of Address

The Member shall promptly notify the Bank of any change of correspondence address. In addition, the Member shall also promptly notify the Bank of any change of the current employer and / or office address.

5.2 Waiver

No forbearance, neglect or waiver by the Bank in the enforcement of any of these Terms and Conditions shall prejudice the Bank's right thereafter to strictly enforce the same.

5.3 Amendment of Terms and Conditions

The Bank reserves the right to vary, amend, add or delete these Terms and Conditions at any time and from time to time at its absolute discretion. If any PB customer does not accept changes, he / she shall promptly given notice to the Bank to terminate his / her Priority Banking membership and the Bank may withdraw any or all of the services from the Member. If the Member continues to use the services after notification, the Member shall be deemed to have accepted and agreed to such variation, amendment, addition or deletion without reservation.

5.4 Governing Law

These Terms and Conditions shall be governed by and construed in accordance to the laws of Malaysia and the Member hereby agrees to:

a) submit to the non-exclusive jurisdiction of the courts in Malaysia

5.5 New Products / Services

The Bank may from time to time introduce new products and services for the benefit of its Members generally. The Member's acceptance in the manner prescribed by the Bank and use of such new or additional product, features or services shall be deemed acceptance by the Members of the terms and conditions of the respective products and services and such additional terms and conditions (if any) as may be prescribed by the Bank.

5.6 Disclaimer & Limitation of Liability

Without prejudice to any other provision herein, the Bank shall not be liable to the Member or any third party for damages, loss of profits or earnings, goodwill or any type of special / exemplary, incidental, direct or consequential loss or damage howsoever arising whether by way of omission, negligence, any breach of contract or otherwise and whether or not the Bank has been advised of the same for any of the following:-

i. as a result of any unauthorized transactions carried out on the Member's account(s) before the Bank has actual written notice of the same or before the Bank is able to prevent such unauthorized transactions from being carried out; or

ii. in the event the Bank is unable to perform any operations or to provide any of the services due to any reason beyond the Bank's control including but not limited to fire, earthquake, landslides, flood, epidemic, natural catastrophe or act of God, accident, riots, civil disturbances, industrial disputes, act of public enemy, embargo, war, fuel supply or any factor in a nature of a force majeure or beyond the control of the Bank,

and in the event the Bank is found liable, the Bank's sole and entire liability for such demands, claims or action shall not exceed the amount of the transaction involved which gave rise to the claim.

5.7 Disclosure

The Member hereby expressly consents and authorizes the Bank to disclose at any time without any reference or liability to the Member any information regarding the Member's affairs, account(s), facilities and their conduct thereof to Bank Negara Malaysia, Biro Maklumat Cek, any authority, bodies or agencies (whether monetary, governmental or non-governmental), any guarantor(s) / security parties and any corporations which are related to the Bank by virtue of section 6 of the Companies Act 1965 to such extent and for such purposes as the Bank may in its absolute discretion deem necessary or expedient.

5.8 Interpretation and Definitions

In these Terms and Conditions, unless the context requires otherwise:-

(a) The term "Bank" shall mean Hong Leong Bank Berhad.

(b) The term "Business Day" shall mean a day on which the Bank is opened for business in Kuala Lumpur and any other state in which the transactions of the nature required or contemplated in these Terms and Conditions are to be carried out or effected (excluding the official weekends recognized in the respective State in Malaysia ).

(c) The term "liquid assets" shall have the meaning ascribed to it in clause 1.1 above.

(d) The term "Minimum Balance" shall have the meaning ascribed to it in clause 1.1 above.

(e) The term "Member" shall mean the person(s) to whom and for whose use the PB Card is issued by the Bank and shall include his/her/their respective estates, heirs, personal representatives and successors-in-title. Where there are two or more persons comprised in the term "Member", instructions, agreements and undertaking expressed to be issued by one person shall be binding on the other jointly and severally and a reference to "Member" herein shall be a reference to anyone or all of them.

(f) The term "the PB Card" shall have the meaning ascribed to it in clause 3.1.1.

(g) Words importing the singular shall include the plural and vice versa. Words importing the masculine gender shall include the feminine and neuter gender and vice versa.

(h) The headings and sub-headings herein are for ease of reference only and shall be ignored in construing the provisions of these Terms and Conditions.
